What Are the Penalties for Subsequent DUI Offenses in Georgia?

Georgia considers it a DUI offense if a person's blood alcohol content (BAC) is .08 percent or higher, or if a driver is impaired by drugs. If the driver is underage, then they only need a .02 percent BAC to be charged. A commercial vehicle driver needs only a .04 percent BAC to be charged. If you have already been convicted of one of the above drugged or drunk driving charges within the past 10 years and are facing DUI charges again, the stakes are even higher this time around.

For a 2nd DUI offense, you could face:

• $600 to $1,000 fines
